Auction Terms

These terms apply to timed online auctions on equipment.bucketsofink.com, together with the Buyer Terms of Sale. If the two disagree about an auction, these terms win.

A1. Registering to bid

You need a Buckets of Ink account to bid, and we may ask you to verify your ID once (a photo of your driver's license and a selfie, checked by Stripe; we never see or store the photos). We may ask for your business name, address, phone number and a payment method or deposit before approving you, and we may approve, limit or refuse any bidder at our discretion. You must be at least 18 and able to enter a binding contract. You're responsible for every bid made from your account, so keep your password private.

A2. Bids are binding

Every bid is a binding offer to buy the item at that price, plus the buyer's premium, sales tax and any freight you choose. You can't withdraw a bid once it's placed, except where the law requires it. If you use automatic (maximum) bidding, the system bids for you, one increment at a time, up to your maximum.

A3. Buyer's premium

A buyer's premium of 12% of the winning bid is added to every item and is shown on each listing before you bid. The premium is part of the price you pay and is taxed where sales tax applies.

A4. Reserve prices

Some items have a reserve, a hidden minimum price set by the seller. The listing says when there's a reserve and whether it has been met. If bidding ends below the reserve, the item isn't sold, and the seller may offer it to the highest bidder at the reserve price or relist it. Items marked "No reserve" sell to the highest bidder at any price.

A5. How an auction ends (extended bidding)

Each item has its own closing time. If a bid is placed in the last 2 minutes, the closing time for that item moves out by 2 minutes from that bid, and keeps doing so until no one bids for 2 minutes. The site's clock decides closing times. We aren't responsible for bids that don't reach us in time because of your internet connection, device or browser.

A6. Winning

When an item closes, the highest bid that meets any reserve wins. The winning bid is a binding contract to buy the item on these terms. We'll email your invoice, with a link to pay, after the auction closes.

A7. Paying for what you win

Payment is due within 3 business days of the auction closing. The payment methods and limits in the Buyer Terms apply: card or bank (ACH) under $5,000, bank (ACH) or approved financing at $5,000 and over. If you're financing, your lender's approval must be in place before you bid on a financed purchase, and the lender must pay within the same 3 business days unless we agree otherwise in writing.

A8. If you don't pay

  • We may cancel the sale, suspend or close your account, and keep any deposit.
  • Card on file. To bid on a lot whose starting bid, current bid or your bid is $10,000 or more, you must have a card saved in your account. We don't charge or hold it when you bid. If you win and don't pay as these terms require, you authorize us to charge it a $500 non-payment fee, on top of everything else in this section.
  • We may offer the item to the next-highest bidder or relist it.
  • You are responsible for any shortfall between your winning bid and what the item later sells for, plus the buyer's premium you would have paid, relisting costs, storage, and our collection costs, including attorney fees.

A9. Pickup and freight

The pickup, storage and abandonment rules in the Buyer Terms apply: pick up within 14 days after your payment clears, storage of $25 per day after that, and items not collected within 30 days may be treated as abandoned. Freight booked through Buckets of Ink is covered by the Freight Terms.

A10. Fair bidding

Shill bidding is not allowed: no one may bid to push up the price of an item they own, sell, or have an interest in, or on behalf of the seller. Sellers may not bid on their own items, directly or through anyone else. Bidders may not agree with each other to hold prices down. We monitor bidding, and we may cancel bids, void a sale and close accounts involved in any of this.

A11. As is, where is

AUCTION ITEMS ARE SOLD AS IS, WHERE IS, WITH ALL FAULTS AND NO WARRANTY OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND TITLE, exactly as described in section 2 of the Buyer Terms. Inspect before you bid. A machine's description, photos and condition report come from the seller. Sections 2A (title and liens), 9 (all sales final), 10 (card disputes), 10A (using the equipment) and 11 (limits, law, costs, release, taxes and personal guaranty) of the Buyer Terms apply to every auction purchase and every bid.

Every auction is conducted by Buckets of Ink from Tempe, Arizona, and every auction sale is made in Arizona, wherever the bidder, seller or equipment is located.

A12. Mistakes, outages and changes

We may correct an obvious error in a listing, withdraw an item before it closes, extend or restart an auction, or cancel bids if the site has a technical problem that affects bidding. If a listing has a material error that we find after the auction, we may cancel the sale and refund anything you paid. Our total liability for any problem with an auction is limited to the commission we earned on the item.

A13. Disputes

Tell us about any problem with an auction within 48 hours of it closing by calling 480-229-7806 or replying to your invoice email. After that, the result stands. Arizona law applies, wherever you are located, and disputes are decided only in the state or federal courts in Maricopa County, Arizona. The jury and class waiver in section 11 of the Buyer Terms applies.
